TERMS AND CONDITIONS
1. AGREEMENT: Scotia Lodge (DBA Humboldt Bay Social Club Inc.), and Guest agree as follows: Guest is over the age of 21 and will be an occupant of the unit during the entire reserved period. Other occupants will be family members, friends, or responsible adults. Use of the premises will be denied to persons not falling within the foregoing categories, and as a result they would have to vacate the property immediately without any refund. Furthermore, for unforeseeable reasons, if a unit becomes unavailable, even if you have reserved it, due to circumstances beyond our control, Scotia Lodge (DBA Humboldt Bay Social Club Inc.) will make its best effort to offer other accommodations if available.
2. Payment Schedule: On the day of booking, Scotia Lodge (DBA Humboldt Bay Social Club Inc.) collects prepayment of the first night’s rate and taxes. Upon check-in your credit card will be authorized for the remaining balance, and will be charged upon check-out, including any additional fees or services accrued during your stay.
3. Cancellation Policy: Cancellations made within 72 hours of booking will receive a full refund excluding a $25 cancellation fee.
Cancellations made 30 days or more before their reservation will receive a refund minus their first night stay. Cancellations made within 30 days of their stay will not be eligible for a refund. There are no refunds for cancellations due to weather, roads, earthquakes, fires, or other situations beyond our control.
4. PETS: We allow pets in some of our units. An additional pet cleaning fee is required $35 per night. Your pet must be on a leash or on reliable voice command. You must clean up after your pet, which includes properly disposing of all waste material. You must also maintain control of your pet at all times, and never leave a pet unattended in the units or on the grounds. Any complaints from other guests regarding noise or other nuisances may be cause for immediate termination of the reservation. If we have evidence of a pet being at the property, and you have not been given written permission by us to have a pet, you will be charged $150 plus the cost of repairing any damage to the property.
5. ALL OF OUR BUILDINGS ARE NON-SMOKING. If there is evidence of smoking or vaping inside any of our buildings, you will be charged an additional $150 plus the cost of repairing any damage to the property.
6. CREDIT CARD PAYMENTS: Payments by Credit Card. This acceptance confirms authorization for Scotia Lodge (DBA Humboldt Bay Social Club Inc.) to hold the Credit Card Account for the required amount to confirm the reservation, and then subsequently the remaining balance to complete the full payment of said reservation. Also note that your credit card will be charged any excess charges if deemed necessary from any damages, missing items, or late checkouts.
7. GUEST LIABILITY: Guest agrees to accept liability for any damages caused to the property (other than normal wear and tear), including, but not limited to, landscaping, misuse of appliances, and/or equipment furnished. Guest agrees to reimburse Scotia Lodge (DBA Humboldt Bay Social Club Inc.) for costs incurred to repair/replace damaged items.
8. SLEEPING CAPACITY/DISTURBANCES: Guests and all other occupants will be required to vacate the premises and forfeit all payments made for any of the following: A. Occupancy exceeding the sleeping capacity stated on the website. B. Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age. C. Causing damage to the premises rented or to any of the neighboring properties. D. Any other acts which interferes with neighbors' right to quiet enjoyment of their property. Please keep cars and traffic to a minimum. Events such as weddings and parties at any of our locations are possible with additional planning and fees. No unauthorized parties or events of any size are permitted, and may be cause for immediate eviction.
9. HOLD HARMLESS: Scotia Lodge (DBA Humboldt Bay Social Club Inc.) does not assume any liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing. Nor will Scotia Lodge (DBA Humboldt Bay Social Club Inc.) accept liability for any loss or damage caused by weather conditions, natural disasters, pandemics, acts of G-d or nature, building defects, or other reasons beyond its control. It is the responsibility of the guest to monitor and plan for weather, road, and travel conditions, advisories, and or restrictions that may impact their stay. Do not allow children or pets to roam the property unattended.
10. TUBS, PATIOS, SAUNAS, FIREPLACES, FIREPITS, RECREATIONAL EQUIPMENT: Guest hereby acknowledges that if the property reserved includes any of the previously listed items, the Guest is fully aware that the use of those items can be dangerous and that injury is likely to occur to anyone who is not careful. Children should never be left unattended. Tenants should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the Guest accepts and assumes all risks involved in or related to the use of all of the listed items. Also, our tubs are professionally maintained and we strive to keep them in welcoming condition. If they do not appear in satisfactory condition to you, please notify us immediately and we will have them checked.
11. ADDITIONAL TERMS AND CONDITIONS: The guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Scotia Lodge (DBA Humboldt Bay Social Club Inc.) from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the Guest, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs. Any and all legal suits must be filed in Humboldt County in the state of California.
